サン・マルタン島は長年フランスのコミューンであり、フランスの海外地域および県であり、したがって欧州連合に加盟しているグアドループの一部を形成していました。2003年、島のフランス領の住民は、フランスの別の海外共同体（COM）を形成するために、グアドループからの分離に賛成票を投じました。 [ 1 ] 2007年2月9日、 フランス議会はサン・マルタン島のフランス領と隣接するサン・バルテルミー島の両方にCOMの地位を付与する法案を可決しました。[ 2 ]新しい地位は、2007年2月15日に地方議会が選出された時点で発効しました。[ 3 ]サン・マルタン島は欧州連合 の一部であり続けます。[ 4 ]
海外共同体としての新たな統治機構は、2007年7月15日に領土評議会（フランス語：Conseil territorial ）の第1回会議と領土評議会議長としてのルイ・コンスタン・フレミングの選出をもって発効した。2008年7月25日、フレミングは2007年の選挙運動における問題で国会（ Conseil d'État ）から1年間の制裁を受け辞任した。[ 5 ] 8月7日、フランツ・ガムブスが領土評議会議長に選出された。[ 6 ] しかし、2009年4月10日に彼の選出は無効と宣言され、 2009年4月14日、ダニエル・ギブスが領土評議会議長代行に任命された。 [ 7 ]しかし、ガムブスは2009年5月5日に再選された。[ 8 ]
